Rawson Properties - Empty promises
We had viewed this apartment in Strand, and on viewing the apartment had some insects. We decided to go ahead and take it, and advised per the agent that we could only get the place if we paid an advance amount. Which we had done, the second day of living in the apartment we found out that there was a problem with the geyser, and the maintenance manager of the complex was aware about it.He had brought it to our attention, so now there is an impression that they were fully aware of the matter.
We had sent along email explaining the problem with the geyser, the patio which I asked them to paint before we moved in, the stove which was not functioning and the insect infestation. To which only the geyser was replaced. I have then advised them all via email of the above mentioned things that needed to be replaced, repaired or fumigated. This was still not done, I then spoke to Jacqui Savage who had gotten involved and advised Rawson Somerset to fix, repair or fumigate. To which Rawson properties somerset has not done anything about. I had to advise Jacqui again that nothing has been done, and Jacqui advised that the owner was in breach of contract and we had the go ahead to cancel. Then Schalk got involved to advise that Jacqui cannot make decisions like that as it is his franchise. We then spoke to Schalk face to face explaining everything above and how we are currently living in an inhospitable environment and that the insects were getting worse and where we received an email from Marilyn expressing that they are aware of the problem and its been going on for some time now.
We therefore received the go ahead to be let out of our lease by Schalk and moved out at the end of October 2019. He advised that we would receive our money back from the 6 months advance rent paid upfront as we only stayed there 3 months. We enquired if we could see other properties with Rawson and never received a callback from the agent. We found a place and wanted to use the 3 months owed to us as a deposit for the new place. Which we have not received, instead we had to make another plan.
I have called Schalk repeatedly and asked for the money due, he has said that he is waiting for the owner to pay it into his account, also advised that should there be new tenants we would get the refund, currently there is new tenants for 2 months now and we still haven't received our refund.
I have called him repeatedly and mailed him repeatedly but with no response at all. What do I do?
