Pushed out our house by our own RAWSON agent

<p>We chose RAWSON Properties to assist us with the sale of our house in Claremont Cape Town. We had already found our future new home(in Villiersdorp) and RAWSON got our house on the market and the sales proceeded. Exciting times lay ahead we thought.</p> <p>As our buyer was renting in Rondebosch they did not want to rent for another month due to the increased rental and obvious excitement for their first bought home. Our RAWSON agent asked us if the new owners to be, could possibly move in prior to transfer at an agreed Occupational rental. We said that would not be a problem as long as we had the same dates to move into our new home. Our RAWSON agent got us to sign an agreement of occupational rental along with a date as our buyer had now handed in their notice with their landlord. In GOODFAITH we signed assuming all along that the RAWSON agent was very aware that this was all only going to be possible if we too had secured our new home for early occupation. Also the fact that we are the paying client we automatically assumed that RAWSON was acting with our best interests at heart. Taking into consideration we have 3 children, 2 dogs, a cat and 2 hens.</p> <p>We AGAIN said that this would only be possible if we had occupation to our new home at the same time… OBVIOUS. I continuously informed our RAWSON agent that we had not secured our new home for early occupation. The attorneys tried to assist but to no avail. We were then told by the RAWSON agent that we would have to vacate our house regardless of not having early occupation at our future home. I repeatedly told her that we had nowhere to go, and as the house was/is still in our name that surely our buyer would be in a much more flexible position to make a deal with their current landlord for a small extension on their lease until transfer was done…, also taking into consideration that their landlord had not secured new tenants.</p> <p>Our RAWSON appointed attorneys then wrote to us and gave us 48 hours to be out of our house or we would face legal charges and even face being sued. We were horrified and panicked. We organised a removal company at very short notice and house contents into storage.</p> <p>We have got our hens to a friend’s house in Mowbray where they are still waiting for our new home to become available. We moved out to a friend’s garage in Newlands along with our 2 dogs and terrified cat. ON arrival in Newlands our darling cat escaped and we still have no trace of her.</p> <p>Since our sudden departure we have continuously asked RAWSON to help us. They are completely ignoring our plight and have not once offered to help accommodate us in our new Town. Two of our children in grade 4 and grade 6 are still not in their school as we are having to bunk with various friends in Cape Town until our new home becomes available and our current home has been lovingly handed over by RAWSON to our new owners TO BE.</p> <p>We are devastated with the way RAWSON have not looked after us their client at all. Our children and ourselves are traumatised and extremely emotional to say the least. Our darling cat Pandora unlikely to be found as she escaped in unfami**** territory.</p> <p>The particular estate agent involved has NOT ONCE contacted us to even assist or enquire about us. We have been made aware by another Estate agent that when an occupational rental is agreed upon, that NO DATE is to be written in the agreement until all parties involved have secured accomdation.</p> <p>My husband was also informed by one of RAWSON’s managers Wayne Albutt that this had in fact happened a couple of years ago creating a very traumatic and unnecessary event. He then proceeded to say that they had put systems in place so that this kind of thing would never happen again……. We have not heard from him since. We are stunned, shocked, and extremely saddened with this despicable conduct and lack of client care. They refuse to accept responisbilty and even assist us.</p> <p> </p> <p> </p>
