Breach of contract

We recently purchased a home in Parktown North. Before purchasing the property, we specifically inquired from Mr. Justin Smith, the presiding estate agent, as well as the owners if there was any rising damp or roof leakages.<br> <br> We were assured that the rising damp was confined to one wall and roof leakage to a single spot. On occupation we discovered that the walls behind the kitchen cabinets and appliances are swolen and crumbling due to huge amounts of rising damp. <br> <br> On top of this, during the first rain storm the garage resembled a shower head due to leakages at all the connecting ***** spots.<br> <br> In accordance with the latent defect rule related to the footstoots clause, I am in my full rights to report these defects as they were undisclosed and will need to be repaired at great cost. Justin agreed to come and inspect the defects. Out of the blue we received a correspondence that the previous owner is unwilling to admit to the defects and we can follow legal action if we choose but they believe they are not liable. Thus our request for inspection.<br> <br> After numerous calls over 2 months, Justin is yet to return our calls or conduct an inspection after we spent millions. Unacceptable!!!
