<div>On the 30th December 2015 I purchased a Toyota Verso at Raceview Motors in Alberton with the aim of making money as I was not working. It was costing R105 000 which I paid cash and drove the car to Eastern Cape on the same day. I was made aware by the sales person Gerrie Groenewald that the car is a second hand but all in order with a few faults that I will fix when I'm in Eastern Cape, i.e. the hooter that was not working, change of ownership, wipers, the key, which they confirmed that they will pay the invoices. Gerrie who was a salesman said they will give me a month warranty as 1000 kms would not be sufficient as I was driving to far.

It was around 18H00 when I left Alberton to Idutywa. Then I reached Butterworth around 04h00 a.m. and decided to sleep over there. In the morning of the 31st December 2015 I headed home to Idutywa. Then while I was just less than 2 km away from home the car switched off and couldn't start. I then called my brothers to assist. I called Gerrie who gave my brother a few instructions but all in vain, that’s when we had decided to tow the car home. Then Gerrie suggested that I take the car to the nearest Toyota which is in Umtata. I towed the car to Umtata on the 11th January 2016 for evaluation. On the 18th January I received a call from Toyota that they scanned the engine and found that the problem is in the gear box which they can only strip the car once a payment of R3000 is made. I therefore gave feedback to Raceview Motors (Gerrie) and he asked for the contact details for Toyota Umtata.

At 13H30 on the 20th January 2016 I received a call from Juan whom I believe is a Sales Manager at Raceview Motors that he called Toyota Umtata and got the report that there is no problem with the gear box. He even confirmed if I said I want to return the car to them and get the refund. He further said if I return back the car I will not get the full amount as I drove the car and on top of that the car did not have any problems. He will deduct the amount that will cost the repairs though he said Toyota confirmed that the gear box does not have problems. I repeatedly asked him if he meant to say I'm the one who broke the car and he said yes.

I then lodged the complaint with NCC on the 20thJanuary 2016 whereby NCC suggested that I should first refer the matter to Motor Industry Ombudsman SA. I then lodged the complaint with MIOSA on the 27th January 2016. I dealt with several people at MIOSA with no reason known by me. I first liaised with Marel Raymond (whose position is not indicated on the signature line) while I lodged the case. S/He was the one who sent me the complaint form to complete and later the case was referred to Nick Brandt whom was referred to as Case Manager and later on was liaising with Lizzette Kruger who is regarded to as Case Manager Assistant. I have been sending emails to Lizette Kruger who was not responding and I cannot even get hold of anybody when trying to call them. And later on the case was referred and handled by Thava Chinsamy. MIOSA passed the vedict in December 2017 that Raceview Motors are liable and I must send the complaint to NCC if not getting any response. I haven’t heard from NCC till to date.</div>
