Condition of the Sneaker

Yesterday I bought a sneaker from Poetry stores in Canal, I was schocked this am when I wanted to wear the shoe and the condition is shocking . I did not fit the shoe and I remember the store agent checking the shoe yesterday before giving it to me and she gave the shoe in this condition (dirty) this was a set-aside 36340 surely they should have seen that the sneaker is dirty. I had to drive 14km to go collect the sneaker at the store. Now I have to drive back to return the shoe-*my fuel +time*you could see the shoe was worn or fitted on . See pics attached.
