Unsuccessful Liability Claim: PnP Tygervalley

I got injured on 13 December 2019 when a lollipop stand was nock ovee and hit me in my calve, damaging my jean and the blood was visible as it was coming through the jean.

I reported it to the manager of the shop. She indicated that she would contact me the next day. I didn't hear back from her and send an email to her and head office. She then contacted me in minutes. I explained to her that the wound is burning and is swollen and bruised. I explained to her that my medical aid was depleted amd asked if pnp will cover my medical expenses on which she rep**** that she can only forward it to her head office and there is no guarantee that pnp will pay it.

I then cleared the wound again and put bactroban and a plaster on the wound.

On the Tuesday I heatd again from the store manager indicating that I must send proof of damaged jean and injury to her and that someone will contact me regarding my claim as she will not be dealing with it anymore.

I first heard again from pnp on ***0 when I received an email from a legal advisor requesting my correct contact details which I sent to her the same day.

The legal advisor contacted me for the first time on 7 January 2020.

She indicated that the matter will be resolved within days. I send her also the photos inficating my injury and damaged jean.

Eventually after several emails I said I would settle for R5000. Then I was told that I must proof R5000. I then said I would settle for R2500 to replace jean, pain and emotional suffering.

This morning at 9am I received and email indicating that they would send me release and settlement papers for R2500.

Hours later I was told pnp has push back and that R2500 needs to be motivated in terms of costs incurred.

I have a permanent scar on my leg and pnp wants to know why they should pay me for pain and emotional suffering!! Really!!!
