Peugeot -Citroen Tygervalley (TERRIBLE WARRANTIES, SERVICE AND SUPPORT)

This company is not Citroen directly and they are only a reseller that sold me the car December of 2016, but yet they advertise themselves as Peugeot - Citroen Tygervalley on all their branding and paperwork.

My vehicle still has an active service plan and warranty plan currently. My Aircon Gas has run out after being 2 years old. According to research and investigation generally cars lose between 10% to 20% aircon gas per annum, and in my case i lost 100% in just over 2 years. My Vehicle Aircon is problematic and the gas of it has now run out or leaked completely. Citroen-Peugoet Tyrgervalley informed me that they don't have a machine to completely test or fill the gas to prove whether the gas is empty because of a leak or natural use. So they informed me that they can send my car away to get it tested and filled up with gas but I must pay the bill for the testing which could be up to R7000 and if the test proves that the aircon is the problem then they will refer me to citroen directly to request a refund and if citroen feels it's a valid reason they will pay it back or not.

They have come back to me now informing me that they will not assist in any other way.

I have to pay for the aircon gas to be tested and filled, after this process will they do an investigation only to determine whats wrong.

Vehicle   : Citroën C4 Cactus  -  (Sept 2016 model) --  Case: *** - Aircon not working.  
As per the dealership, the aircon system has no gas in order to operate. 
The vehicle has to be sent away for a re-gas, hence the re-gas is not covered under warranty at this point in time.
PCSA warranty advised the dealership that the customer must pay for the re-gas and then the air con needs to be diagnosed.  If a component is faulty then warranty will only cover the 2nd re-gas. Feedback was granted to the customer.

Unfortunately your response is not a good one at all.

1. My frustration is that the dealership does not have the equipment to test why the gas ran out in under 3 years of purchasing this vehicle new from them.

2. I (The Client) need to pay for the aircon to be tested and re-gassed, even though the dealership can not prove that theres not a fault with the aircon.

3. Generally Aircon gas loses 10 to 20% of its gas PER ANNUM, and in my case i lost 100% gas in just over 2 years within the Warranty of all my parts.

4. I asked the dealership to go through the process of proving that the gas ran out without any problems with the aircon and they simply said, NO THE CLIENT NEEDS TO PAY FOR THESE TESTS WHICH INCLUDES THE RE-GASSING AND THEN THEY WILL TAKE IT FROM THERE ON.


NOT FARE AND according to what your warranty indicates.

The Motor Industry Ombudsman of South Africa (MIOSA) and the South African Automotive Industry Code of Conduct (Code) was accredited by the Department of Trade and Industry on the 3rd October 2014. The Code was published in the Government Gazette on Friday, 17 October 2014, Notice 817, Government Gazette No. 38107(3) and can be found on our website www.miosa.co.za.

With the above in mind, attached, please find the complaint documents which were submitted to this office for your attention and response. In order to save time, it is a requirement that all related documentation eg. Offer to Purchase; job cards; invoices; email correspondence; quotations etc. are supp**** with your response. It is in your best interest to present and prove your position in this dispute.

The MIOSA is an independent, impartial, neutral party, conciliating in disputes with the intention of bringing about finality in accordance to good customer relations, good engineering practice and law. We represent neither party and so rely on both parties to impart their side of matters truthfully and factually.

We wish to confirm that failure or refusal to assist the MIOSA in exercising a power or performing a duty delegated as per the accredited Code might constitute ******** conduct in terms of section 108(1) of the Consumer Protection Act No. 68 of 2008 (CPA). In terms of section 82(8) of the CPA, a supplier must not, in the ordinary course of business, contravene an applicable industry code. In terms of section 21.1 of the Code any party will be required to respect the request by the MIOSA within 10 days of receiving notification from the MIOSA.

An administrative fine of 10% of the suppliers annual turnover during the preceding financial year, or a fine of R1 000 000.00 may be imposed by the National Consumer Tribunal.

It is therefore in your own interest to comply as the MIOSA will apply the above provisions on a very strict basis.
