Still waiting for phone bought 3 weeks ago

Bought a phone on 27 March 2015, 3 weeks later, I call and find out that the phone has been lost as the truck was 'hijacked'. But then the hijacking happened 2 days ago, and the phone hasn't arrived in 4 weeks. This online store does not deliver. They keep saying they don't know when FEDEX will get back to them about the lost goods. They are hiding behind claims that are unfounded since the shipping was supposed to have happened 8 days after the phone was bought.
