Ooba Fails to pay out damages that I was not the cause off to my property

on 26 Feb 2021 I noticed water seeping through our house bottom walls water after it was raining and through the weekend as it rained. Next door owner did stuff against The National Building Regulations and Building Standards Act 103 of 1977.

Now I am hold accountable for what he did and I sit with the damages

Ooba informed me that they will not pay any damages occurred due to there info: 3. Exclusions Applicable to House Owners Section only The following are not covered: 3.6 loss or damage caused by or attributable to defective design, specification, construction or material; 3.7 loss or damage caused by any gradually operating circumstances; 3.8 loss or damage if the Dwelling fails to conform to the National Building Regulations or similar legislation applying at the time of the Dwelling’s original erection / construction

I must get a layer and independent person and sort out the owner next door. How do I keep my next door owner in control. He will just laugh at me. All my drawings are in tact and approved by Municipality and is legal. Then must endure all this negative and uncomfortable experience. What to do? Need advice from somebody that experienced the same to give advice please. Everybody says it is not fare.
