Selling goods they don't have

I made an order on OneDayOnly. Confirmation of the order (and payment) stated that delivery would be 5-10 days. Two weeks later I was still to receive my goods.

I followed up with them, and was told that the delay was on the supplier's end, and that my product would be delivered in 5 days. Another follow-up gave me exactly the same answer. Following up again I received a phone call, wherein the customer service agent told me that "the supplier" did not have any stock. How do you sell - and take payment for - goods which you do not have?

It's been nearly a month since OneDayOnly took my money, and I have received anything but lame excuses. Feels like a pyramid scheme!
