Treated Unfairly by OSTI Case Number:M1942/19 OSTI Has treated me unfairly, I logged a complaint with OSTI on 10/09/2019 and they responded on the 29/09/2019 by upholding the Insures decision, they clearly stated that their decision was based on the Insures response and offered me an opportunity to contest the Insurers decision…I then analysed the Insurers response and I picked that the Insurer made a decision on the wrong accident scene pictures/or wrong accident scene area and I responded on the 25/10/2019…The ombudsman still rejected my contest on the 3/04/2020 stating that I didn’t submit evidence. I then app**** for a leave for an appeal on the 7/04/2020 to the Appeal Tribunal via the ombudsman who was handling my complain as instructed by the Appeal mechanism to review the Ombudsman decision or the Ombudsman to direct otherwise, I personal went to the scene area and took pictures of the scene area with evidence and supp**** the Ombudsman whose was handling my case with the right accident photos and accident area for the Appeal Tribunal to review or the Ombudsman to direct otherwise…but to my surprise when I call 11/06/2020,I am being told that I should consider the Ombudsman rejection letter dated 3/04/2020 as Finale, yet on the Appeal mechanism found on the OSTI website, it is clearly stated that an applicant has a right to apply for an appeal against the rulings or finding of the ombudsman. And it is also stated that, where leave to appeal against any ruling or finding of the ombudsman is refused by the ombudsman, the unsuccessful party may, within 15 business days of notification of such refusal, petition the Chairman of the Appeal Tribunal, to review the decision of the ombudsman not to grant leave for appeal. Now It becomes unfairly when you are being refused a right to appeal over telephonically conversation and worse when you were phoning enquiring about an update that was promised and never honoured.
I reviewed the file, and confirmed that on 11 June 2020, your matter was escalated to a Senior Assistant Ombudsman, Mr. Peter Nkhuna, on review according to the process followed in our office.
