The Ombudsman office failed me

The car was in an accident on 10 May 2015. 3 from airbags exploded. The insurance took my car to be fixed by a non approved panel beater. The Car lost its warranty, and no Ford dealer wanted to sign off the car as it was badly fixed. I took my case to the Ombudsman then the insurance **** and said I am the one who instructed them to take my car to that panel beater and they even claimed that the investigator told me that the panel beater is not ford approved but I insisted. I asked the Ombudsman Office to ask for a recording that was made by the investigator when he came to see me, I gave the Ombudsman all the necessary emails between me and the insurance to prove that they are the ones that came with that panel beater. I even went to a ford approved panel beater to get a report on the car, I had to pay for this inspection which stated everything wrong on the car (This was sent to the Ombudsman). I even went to a ford workshop to get a full report on the car and how much the car would cost if I were to trade in(This was Also sent to the Ombudsman). But to my surprise the Ombudsman came back saying according to the evidence received THE CAR WAS PROPERLY FIXED ACCORDING TO FRD STND

Hello zola***,

We have looked into the matter and note that the matter is still on-going, contrary to the suggestion that there is a particular outcome.

A final determination will be made once the investigation is completed.

We however take this opportunity to point out that, that determination will be based on the facts and evidence presented and proved by the respective parties. The Ombudsman cannot make any determination which is not based on evidence.

It must also be borne in mind that the complainant bears the onus of proving their claim or complaint, and that if they fail in this regard, they should not expect a favourable outcome.

Currently, there is a dispute regarding the adequacy or otherwise of the repairs and, depending on the evidence available, the outcome could go in any direction.

Our investigations continue, and you will be updated in due course.

Yours faithfully

Peter Nkhuna
Senior Assistant Ombudsman
