Should Customers pay for Insurance company's error

I laid a complain with The Ombudsman for Short Term Insurance about the error that Regent insurance has done which resulted in me having to pay for it and the case took almost a year. The response I got from Ms Valerie Mngadi was that the insurance company says they are correct. What is the use of the Ombudsman if they are going to take what ever the insurance company is saying and not investigate to find who was at fault? This case was easy because the insurance company has admitted to doing the error but the don't wanna be accountable. This makes us wonder if there was no under deals that were made here because the Ombudsman failed to make the decision on their own but based their conclusion of case S293/18M on what he insurance company is saying.

I have reviewed the decision which was made by Ms. Mngadi on behalf of our office and found that it was based purely on what is provided in the terms and conditions of your policy.

Whilst your vehicle credit shortfall policy provided for a contribution towards your comprehensive motor vehicle excess, like all other policies, this cover was provided under specific terms and conditions clearly set out in your policy documents. The insurer's contribution towards your excess was not a stand alone cover and would only be made in the event of a valid claim under the vehicle credit shortfall policy. In this case, you did not have a valid vehicle credit shortfall claim and hence the benefit did not come into effect. The decision made in this matter is therefore maintained.
