OSTI Mission Statement: Should read USELESS!

<p>Contacted the in OSTI in Dec 2015 to resolve my issue with my car insurer, who claims misrepresentation. The matter was brought to the OSTI for resolution but that took forever as the finding was not forth coming I had to complain on this website to get a response out of the OSTI and get some traction on the matter. The following day after the complaint the OSTI then suddenly pronounced a finding. Needless to say the response was a hurried haphazard response which favoured the insurance company without considering the facts. Enough proof of this has been given to the OSTI to no avail (see proof extract below).</p> <p> </p> <p>Proof extract: </p> <p>The decision was based off a tape that insurer supp**** in their 2nd response, which I wasn’t informed of, and wasn’t afforded an opportunity to respond to or make a second submission. The said tape was</p> <p>Conveniently, selectively and partially transcribed by insurer. The same said tape was the accident report investigation tape which the OSTI claimed was a sales inception tape when making the wrong finding.</p> <p>This clearly shows it was not listen to at all.</p> <p> </p> <p>Subsequent to this I then placed a claim with my finance insurance to settle my account with MFC, this insurance disputed my claim as well saying it’s based on the fact that the car insurer has disputed. I then brought this matter to the OSTI once again. I made the application, insurer responded and I was given 14 day to respond which I did on 21 Sept 2016. The OSTI was now due to consider the matter and make decision or advise if it was doing anything different. The last communication on the matter came on the 7 October 2016, saying that SOTI (Hannes I think it was) was investigating the matter and will inform me once he is in a position to do so. Really!! What one earth are you people in that office for?? How is that you claim you are helping the public but can’t be impartial and can’t make commitment dates and deliver!!?</p> <p> </p> <p>I tried calling on numerous occasions, and on the 4th Nov 2016, emailed – no response, not even acknowledgement of my communication (this is 4 weeks after the last OSTI communication)</p> <p> </p> <p>Again on 13th Dec 2016 I emailed - no response, not even acknowledgement of my communication (this is 9 weeks after the last OSTI communication)</p> <p> </p> <p>To this day I have called and have gotten no joy out of the OSTI (this is 19 weeks after the last OSTI communication). Really frustrating! What one earth are you people in that office doing?? I am paying for an account –for over a year now! An account that was properly insured and because of the OSTI reckless and partial decision it is not settled! How is that OSTI claims to be helping the public but can’t be impartial and can’t make commitment dates and deliver!!?</p> <p> </p> <p>The people I have dealt with on these matters are a disgrace to the OSTI Mission Statement: To resolve short-term insurance complaints fairly, efficiently and impartially.</p> <p> </p> <p>The office of the OSTI is not functioning at all, to the extent that if a person mentions the words OSTI I can only think of one word: USELESS!</p>

I am advised that there were two files which were opened relating to your disputes.

The first file was closed in April 2016. The finding in that matter had been that the insurer was entitled to decline liability for the claim as you had failed to disclose certain material information when required to do so. We cannot go into the details thereof on this platform.

You were advised to seek legal advice and to pursue that matter further at your election in line with whatever legal advice you received. I does not appear that you either contested the finding or pursued the matter further. It may be too late to do this now. We reiterate that you seek legal advice and proceed accordingly.

Regarding the second file, I am advised that a finding has been made. Same is being processed and will be communicated in due course. It appears that the insurer providing shortfall cover has a provision in terms of which it can also decline liability for your claim. The details will be contained in our communication containing our finding.

We lastly point out that we can only make findings based on the facts and evidence presented by the respective parties.

We trust that you will find the above in order.
