Ombudsman - No good

ABSOLUTELY USELESS! Four companies involved.... GuardRisk, Ooba, Hollard, OSTI

Dunno who to deal with anymore to get anything done, so I'll tag them all.

Four **** companies that cannot seem to do their jobs.

Bunch of *******, super easy for them to take my money every month, but when it comes to replacing the stuff up they caused on my roof, or locate my claim files, suddenly that's a problem.

My roof is constantly getting damaged from the heavy rains, after their initial “repair” of my roof didn’t work properly.

I’ve been dealing with this **** for over a year now, A YEAR!

DO NOT USE THESE COMPANIES AT ALL, EVER!

I will be complaining about them daily till I get my roof fixed.

Dear Brad D

Our records reflect that this matter relates to our file reference D174/22.

Further, that we communicated with you on 11 November 2022 advising that neither your insurer nor the underwriter could locate your claim details. You were required to provide further details so that the matter can be traced by them. On your own version, three different insurers are potentially involved, meaning that the correct insurer is not completely certain.

It further appears that the matter may dates back a while, which would explain why the information may be difficult to access.

We note that you are in correspondence with our office as per your e-mail earlier today and suggest that you let the matter unfold organically.

In addition, it would be ill-advised to post your complaint on this platform every day as you state you will. This will only undermine your own credibility as we will not respond to daily posts. Our efforts would best be directed at assisting other complainants than doing that.

Please note also that any frivolous or vexatious conduct may lead to our office, withdrawing its services.

Generally speaking, one is required to maintain one's roof every 2-3 years. That you state that you were advised that the roof would be good for 8-10 years would not mean that your claims would be valid even if you did not maintain the roof, for example.

Our investigations continue and we hope that you will allow the process to develop.

We trust that the above is in order.

Yours faithfully

Hi Peter

Thanks for the reply, I'm glad you managed to find your response to me on the 11th, and if you look a little harder, you'll find my response to you guys on the 12th, where I actually sent details relating to the original claim, for the insurer to go find, the very information you asked me to provide you with.

I was even sent a reply from OSTI (on the 14th) stating that it had been received, and sent off to the insurer. Nobody can seem to be able to find my claim details, even when I send them to you...

I don't see how it can take someone 6 months to find claim documents, when it literally took me 2 minutes. I would think I have my own folder where all related claims and information are kept?
Surely by now, the correct company should be involved in this and know where to go from here?

In addition, I never specified where I'd be complaining, so you assuming it would be on this platform is ill-advised.

What I am trying to emphasise here is the urgency... I welcome your process, and I would gladly compliment everyone involved, but after 6 months with no results, and my roof constantly getting more damaged, this delay is infuriating.

I'll try deal with Nadia again tomorrow.

Dear Brad D

I am aware of all what you stated. That is why I am also aware of your e-mail of yesterday.

We can only assist you when you provide your details, i.e. the insurance company involved, the policy number and the claim number etc. Our application form requires these details.

In your own earlier post, you mentioned three different insurers. In the complaint itself you stated that you were a bit confused by the insurer's documents that reflected the different insurers. It is not normal that three insurers would be involved in one claim. It is therefore understandable to me why it would have been an issue to establish what was going on, which insurer was involved and what the correct claim details would be (in so far as our office is concerned). If a party involved in the dispute like yourself was a bit baffled by the documents (and seemingly the insurer), surely it should also be understandable when third parties like our office would also be involved in that existing confusion?

Our terms of reference state:

  •  4. THE JURISDICTION OF THE OMBUDSMAN

  • 4.1 The Ombudsman shall only consider a complaint made to him if he is satisfied that:

  •  4.1.6 the complaint is being pursued reasonably by the Complainant and not in a frivolous, vexatious, offensive, threatening or abusive manner, as the Ombudsman may decide in his or her sole discretion;

It therefore dos not matter which platform you use.

We hope we will not have to consider using our terms of reference in the above regard.

Yours faithfully
