No progress!!!! No Response!!!

I am very frustrated right now, hence I find myself in this platform, hoping that this will somehow assist me in getting some sort of progress on my case.

I lodged my complaint with OSTI in July 2021, both myself and the insurer have submitted all the requested documents and now OSTI just doesn't give me any progress on my case. For the past 8 months and counting...I have been paying the insurer premiums for a car that is parked in my garage and not working.

I have been trying to explain with no luck to OSTI that their delay to resolve my matter was costly to me, as I have been forced to use public transportation and had to also hire school transport for my kids, all these are additional expenses, while I am still paying my premiums. On top of that my insurer is receiving money from me monthly, this means for the past 8 months the insurer has not been fulfilling their side of the contract obligation, because the car is not moving, yet premiums are being paid.

I was advised by OSTI not to fix the car until the matter is resolved. Until OSTI gives a verdict to my case, I will be loosing money every month and probably would have spent more than the repair itself. I am really frustrated with this case, maybe I should stop paying the premiums, until the matter is resolved, that way the loss would be on both side.

The last response from OSTI in November 2021 was as follows: "Please note that this office deals with a large volume of matters ,once we have had an opportunity to review the information on record we shall revert." This response doesn't give me assurance or comfort on whether my case is being attend to, if it is, what progress is being made or even when I should expect the final verdict. It seems I am expected to wait, "until they had an opportunity to review my case" which could be more months.

It's strange that we are given times lines to respond, but OSTI can take as long as they see fit, and in that period still not even give assurance whetger the case is indeed being attended to.

This is really infuriating.

The Assistant Ombudsman allocated to your case is still dealing with the matter. The last activity was on 13 January 2022 where he requested additional information from the insurer. This information is necessary for our office to make a finding on the dispute. Only once we have gathered all the necessary information will we make a decision. 

There is no set time in which we resolve complaints. In addition to other factors, the nature and complexity of the issues in a dispute will influence how long it takes to resolve. 

In the interim, and because you are not driving the vehicle, we suggest you consult with your broker or insurer to consider revising the existing cover to one that is more suitable to the changed circumstances of the risk.
