My claim was repudiated by Miway, according to them I was drunk at the time of my accident, and irrespective that Police Officers and Metros on scene did not suspect drinking and driving, a tow truck operator informed the Assessor, she saw alcohol bottles and I struggled to locate my cellphone after my car had rolled a couple of times. I then laid a complaint, ref number:K550/14D//Miway, in October 2014, for the 1st 6weeks I was being informed as to what is happening. Since December 2014, I've not had any kind of feedback whatsoever. When I called in January, Katia informed me to be a bit patient due to Backlog since your office was closed over the Festive season, which I understand fully. When I called your office again, I was told to contact my Legal Rep. The Feedback she's been getting is that a final ruling was made , the response letter is on the way. Every week since January we being to wait. Regardless of backlog, 6weeks is a bit ridiculous to draft a letter. It would have been better if I was informed what the reason(s) for the delay is. Hello sbuda-luda,

We regret that it has taken this long for you to receive further updates.

Our offices close in December and this would indeed lead to a bit of a backlog in January.

As part of our investigation into your matter, we also needed to ensure that there was reliable evidence on the basis of which the insurer sought to decline liability. We had to consider the same. It was therefore not simply a matter of writing a letter for six weeks as suggested by you. There were a few recorded conversations which had to be listened to. Our determination would then be made based thereon.

That determination has already been communicated via an e-mail dispatched yesterday.

In short, the matter involves a factual dispute about your state of sobriety or inebriety and the evidence on record can only be properly tested under cross examination. Our office can therefore not compel the insurer to settle the claim, and the matter has to be pursued further in court.

We trust that you will find the above in order and wish you all the best should you pursue the matter further.
