biased ruling in favor of King Price
I was involved in accident 9 August 2019 whereby I got clipped by another vehicle from the back and my car spun around damaging 2 other vehicles and on lodging a complaint with my insurer (King Price), my claim was rejected on two counts. Drunken driving and speeding to which the OMBUD struck off the being intoxicated charge and King Price hired an accident specialist (Mr. Botha) who provided a data reading from the car (Event Data Recorder) in support of my alleged reckless speed (192 km/h).I lodged a review with the OMBUD as I had gathered proof against the EDR report as a result that the EDR furnished by Mr. Botha is invalid (tampered with and format from the software has been converted to a different one).My interactions with the insurance company were quite restricted as they refused to provide me with information as they advised by email my interaction with them is limited to my cover contract. King Price and Mr. Botha have since refused to provide the actual readings from the car. The OMBUD ruled in favor of King Price even though the information used had been tampered with , doctored and the credentials of the person who pulled the report from the car were not furnished. The OMBUD further reinstates and /or makes mention of drunken driving which was struck off from their earlier ruling. I've made consults with other accident specialists who side with my argument because of noted facts.
Due to the confidentiality clause contained in our Terms of Reference and your signed Application in this office, we are not in a position to address the merits of your claim against the insurer on this platform. I have however reviewed your file and confirmed that the matter was dealt with at the highest level within OSTI. A Final Ruling was issued on 6 October 2021 and it sets out, in detail, the basis on which the office's decision was made.
If you are not happy with OSTI’s decision, your rights are not at all affected. You are not bound by our decisions. You are still free to look for other ways to continue to challenge the insurer’s decision. You can see a lawyer, go to court or pursue other forms of dispute resolution such as arbitration.

I am intent on finding an alternative means to resolve this matter as your organization has let me down. I scratched long and hard to prove to you that the EDR you got from King Price has been changed/doctored , on two separate calls whereby Mr. Botha confirms he changed the format of the report. I am also amazed that whatever piece of paper they provide you believe against the software provider's format and the fact that whoever draws these reports must be certified, I am not trying to tell you how to do your job at the end of the day.
I am reiterating that the EDR you were provided is not the original from my car as confirmed by Mr. Botha(The format and presentation is different from software provider's) and your decision is based on this . King Price has on several emails refused to provide the true EDR as confirmed on emails I've sent you.
The initial ruling made by your office ruled out drunken driving based on evidence furnished and its now being reinstated . What has changed now? The same office with two verdicts on one matter . I am not asking for any favors but fairness was not app**** in this ruling.
