Absolutely Biased and a Waste of Time

I'm not sure if anyone else has experienced that the ombudsman is not objective in their findings. I had 14 days to submit my appeal whoich i did on the same day. I woulkd have assumed that the insurance company also had 14 days to lodge their appeal. I waited for more than 20 days and then followed up and was informed by the ombudsman that they have not received a response from the insurance company as yet. It was so convenient that my final letter from the ombudsman was sent by them on the 19th of December since i told them i am going on leave from the 12th. Can someone pls advise if i can take this matter up with a more reputable body with no costs to myself? Thanks

Dear Mr Govender
According to our records, your claim was correctly declined by the insurer as you were not able to prove that there had been forced entry into the vehicle at the time of loss. By your own admission you only found the door "not fully closed", with no visible damage.
The policy has a provision in terms of which the insurer would be entitled to decline liability for your claim under the circumstances.
As our findings can only be based on fact and law, it is not clear on what basis you would expect a finding that your claim be honoured.
Our file accordingly remains closed.
We reiterate that you may seek legal advice should you maintain your view that you have a valid claim.
Yours faithfully

Dear Mr Nkhula
I would appreciate if you could go back and review my correspondence with the ombudsman. I did send photos showing forced entry.

Dear Mr Govender
We did. There is nothing on the photographs or elsewhere on file which suggests that the locking mechanism was interfered with or damaged to gain access.
You will actually require a proper and detailed report which proves such damage, and subsequent repair of the lock, in order to sustain the argument that there was forced entry. You can then pursue the matter further.

Dear Mr Nkhuna
There is clear evidence that the vehicle's weather strip was bent in order for them to insert a rod inside the vehicle and open the door. This is a very common form of ******* accessing a vehicle.

We cannot conduct the matter on this platform.
Should you require the matter to be re-considered and for you to succeed with same, we will require proper proof (a detailed damage report as mentioned previously) and not speculative submissions. You may then liaise with the person who has been handling your matter for your submissions to be considered further.
