<p>I decided to enter into a lay-bye agreement with OK furniture’s in Atteridgeville. The sales person told me that should I cancel the agreement I will be charged 1% of the amount that I had paid. A week later I decided that I wanted to cancel the contract, so I went to the shop and I decided to read the contract before I entered the shop. The contract provided that I could cancel the contract and will be charged a cancellation fee, however the contract did not specify the percentage or the amount of the cancellation fee. When I got into the shop I explained that I wanted to cancel the contract, then the 1st lady I spoke to asked me if I understood the consequences of my actions and I told her that I understood that I will be charged 1% and that the contract did not specify this. She said that the fact that the sales person told me is enough, the provision does not need to be in the contract and I advised that they need to change it in future. Then the cashier came to refund me the money, she gave R960 instead of R990 (as I had initially paid R1000). I asked why I was being charged more, they said the cancelation fee is actually 10% not 1%. Then I told them that this is why the amount must be stated clearly in the contract and they said it was their system that calculated the cancelation fee and the system will not be wrong, then as I walked out of the shop I realised that 10% was R100 and I was charged R40. This is unfair as it was not clearly stated on the agreement and there was no consensus as their employees don’t even know the actual fee. So they are misrepresenting the company.</p> <p> </p>
