********

**** company this one, Dont make any arrangement and settle with this company, rather pay your creditor directly. You will struggle getting a paid up letter. I have settled a judgement they are refusing to give me a settlement letter stating that specific judgement has been paid, they say i must get my own attorney to do.

Dear Hlayi,

Thank you for settling your account with us and for voicing your concern.

Referring to our previous correspondence, the following had been determined and explained to you relating to this matter:

  1. You have received a settlement offer from our offices and paid same to settle your account.
  2. We cannot provide you with a paid-up letter on our company letterhead because we are not the credit provider. We act on behalf of the credit provider who is referred to as our client.
  3. Per confirmation received from you via email, you have received a paid-up letter (settlement letter) on our client’s letterhead.
  4. Because a Judgment had been granted for arrears on this account, you cannot remove the Judgment from your credit profile with just a paid-up letter, you would have to deal with the Court directly relating to this matter.

The standard process to obtain rescission for a paid-up Judgment is as follows:
  • Approach attorneys on your account to attend to the Application for rescission of the Judgment Granted.
  • Your Attorneys will approach us for an Affidavit consenting to the rescission of the Judgment. We would be able to assist with this as soon as the application is brought forward.
  • With the required documents your attorneys will proceed with the process to obtain rescission of the Judgment through a court order.
  • Once the court has rescinded the judgment, you must send a copy of the court order to the relevant credit bureau’s to update their records accordingly.

In respect of the above we would caution you against making false accusations such as “********” and “they are refusing to give me a settlement letter” which could lead to the defamation of our company reputation.

We trust that you find the above in order.

Please feel free to contact us if you require any further information.

Kind regards
