Pathetic service.

At the begging of this year(2020), in January,I bought a van from Nissan. The main intention of purpose to have purchased the van was to carry out business with it, transporting Johannesburg parks equipment and stuff. 1 months ago, the van unfortunately broke down while still within the business, whereupon it was taken back to the seller and manufacturer; Nissan, however to date Nissan hasn't fixed the van and its still within their possession. This is to say the business has materially been affected as I'm nolonger able to perform my duties and agree on by me and my employer. On estimation, i have lost over R30,000.00. This is very prejudicial to the business. Nissan issued a statement of warranty which is its legal obligation to have the car fixed within a reasonable period, since it is well acquainted with fact that the car is used for business, with the prolonged period that it is still in its possession, the business is affected detrimentally.

We have also made an effort to call and find out about the progress in fixing the car, however Nissan hangs up on us through whoever is responsible for Client's calls and issues; this is an issue for vicarious liability. This is an unreasonable conduct on the part of Nissan not to want to communicate to us about our property that we bought to them and legally as to get fixed by them as per the statement of warranty (also this is the responsibility of each an every manufacturer customarily in the law of sale), Nissan is intentionally defaulting it's legal obligations that it owes to us; being that of having to fix the car.
