Not fixed ongoing problems

I bought a Nissan Juke 1.2t from IC Auto Clearwater Roodeport after settling a long outstanding complaint with a Renault Duster 1.6 that I bought from Renault Clearwater who are on the same premises.

The Renault Duster the battery went flat within a month, the brake disks were so badly worn they were replaced within weeks from purchase, the passenger mirror was replaced with non Renault parts after I bought the car and the agreement was the mirror would be fixed, the window switch drivers side stopped working, the air-con direction switch broke deep inside the dashboard, constant rattling from the dashboard and also the steering not being able to be corrected. I have kept all emails of this.

I had started a civil litigation process and decided against it as the dealership was willing to come to an agreement and I settled for trading in for a Nissan Juke 1.2t. I received a reasonable trade in for the Renault Duster and avoided on the road and registration costs with the Nissan Juke. A bad settlement is better than a good day in court.

However from the beginning with the Nissan Juke, the steering and the steering wheel was not able to be aligned correctly and at fast highway speeds seemed to veer left and right ever so slightly but it was noticeable, the car started making strange noises with the cooling fan or ABS in month two and it was fixed under a temperature sensor although the whole car was shaking. The issue seemed to be fixed. I also from the onset noticed the fuel as extraordinarily high and requested IC Auto Nissan Clearwater to review this, it had not been done only the passenger rear door panel replaced and smaller sundries fixed. The fuel economy went from bad to worse and I took the car into Nissan Sandton in November 2018 only to find out the turbo was damaged.

I picked up the car today 30 November 2018 from Nissan Sandton and the steering was fine, however I was not able to drive the car at normal speed due to bumper to bumper traffic.

After my drive home from work there was not much traffic and I noticed the turbo does not work the mode settings eco, normal and sport there is no difference and in normal mode the torque does not reflect on display and in sport the turbo does not reflect on display in addition from a 10 km journey after the alignment having been done today the alignment is out, which is also what I complained about from the onset that the steering system is worn out. The car either points to the left and I pull the steering to the right or it pulls to the right and I have to pull the car to the left, this is not normal for a one and a half year old car, I can fully understand in an older model and not for the price I paid for this car.

I initially advised the dealership I wish to receive a refund as I only owned the car for 4 months and its the second biggest problem and I was advised to seek assistance from the Motor Industry Ombudsman that will take months to resolve, despite to Section 56 (2) of the Consumer Protection Act, I have the right to return a vehicle to a seller within a 6-month period under certain conditions as I think the car will give me further issues since it is a 2017 model and it is already showing issues an older car should have. I am fully aware that the dealership is hoping for the time to pass as the Motor Industry Ombudsman is slow and the deductions for wear and tear will be much more as the MIO can take several months to come to a decision.

I also sought recourse from Wesbank and to this day I have not received a proper response as I do not think the situation is right.
