Nissan South Africa (Paarl) Shockingly Poor Service & Customer Dissatisfaction With New Car Purchase

I purchased a new Nissan Magnite Acenta AMT from DTM Nissan Paarl which I took delivery of on Friday 25/4/25. After driving home from Paarl, I notified the dealer that I was not happy with the car. This was not buyers remorse due to a colour change but the actual driving ability of the vehicle. When driving from my employers parking area, the car stopped mid-way on the ramp, due to it's sluggishness and inability to climb the incline. The dealer responded sarcastically to this by saying they will take me for a driving lesson, preferably on a Saturday. Is this what the service in South Africa has stooped to? The car cannot pull away from a traffic light nor intersections within a reasonable speed, God forbid something were to happen on the road when needing to move away fast enough.

I've written to the Managing Director of Nissan South Africa as well as the Customer Care Line, with no response as yet.

In the meanwhile, I am not comfortable, nor safe driving this car as I fear that I will be a hazard to my fellow drivers.

I've suggested to the dealer that I purchase the CVT model, with the higher price tag. They agreed, however now wants to take the car back as a trade in with a massive drop in value and I loose my deposit of R40 000.00. This after I communicated my dissatisfaction one business day after taking delivery of the vehicle.

My instruction to the salesman, who has now seemingly disappeared, was that I want an automatic car. This is by no means an automatic car but a manual car which in my opinion is a breach of contract.
