Nissan Magite - Unsafe Car to Drive, UNSATISFIED with vehicle purchased

Vehicle: Nissan Magnite 1.0t Acenta Plus Cvt Purchased: 15 July 2023

TO WHOM I MAY CONCERN

I bought a brand-new Nissan Magnite 1.0t Acenta Plus Cvt with 0km on, within the first 3 weeks, I started having issues with the car:

15/07/2023 Vehicle purchased

04/08/2023 Attend to rattle in dash **removed and refitted dashboard for rattle, secured dashboard

20/04/2024 10 000km service Check if knocking noise when going over humps, suspect shock Check front door handles, left & right side, chrome lifting Check brakes have an extreme grinding noise

25/10/2024 20 000km service

28/10/2024 Please attend to abnormal noise in dash **Dash has been replaced under warranty (this was the 2nd dash, and my car was there for about 1 month to have this done, when I got my car back, the quality control on this replacement was bad, there were gaps, everything was not in place, everything was not connected, then my car went back again, this was for the 1st dash replacement)

28/11/2024 Replacement of brake disks **Brake pads and brake discs have been replaced under warranty

26/07/2025 I had to replace the battery, as the battery was dead Light fixture broke, but they have not yet replaced it (the cabule front light won’t switch off, and keeps on rattle)

01/08/2025 30 000km service Replaced passenger door handle

27/09/2025 I replaced the brake disc pads myself, as it was making a noise

08/11/2025 "airbag error", so they basically told me that the airbags won’t open when in an accident “braking error”

* this car is not fit for purpose and not safe to keep driving like this and no one is doing something*

They can't seem to get my car fixed, and no one wants to make the effort to figure out what is wrong.

My car is not safe to drive but they don’t seem to care instead they are looking for excuses not to get it fixed and blames the problems on other matters.

THIS IS A SERIOUS MATTER AS ITS NOT SAFE FOR ME TO KEEP DRIVING THIS CAR IN THIS CONDITION!!

THIS CAR IS NOT FIT FOR THE PURPOSE I BOUGHT IT-FROM THE START!!!!

I BOUGHT A BRAND-NEW CAR AND HAS BEEN WITH PROBLEMS WITHIN THE FIRST 3 WEEKS I BOUGHT THE CAR AND ITS NOT BEEN FIXED OR FIT FOR PURPOSE.

Consumer Protection Act Section 55 stipulates that goods have to be reasonably suitable for the purposes for which they are generally intended, of good quality, in good working order and free of any defects and should be useable and durable for a reasonable period of time (having regard to the use to which they would normally be put and to all the surrounding circumstances of their supply).

I hope this matter can be resolved ASAP as I reiterate again it’s not safe for me to keep driving this car. And again, I WILL HOLD BB Nissan Gezina RESPONSIBLE FOR ANYTHING THAT HAPPENS TO THIS CAR WHILE I’M DRIVING IT IN THIS CONDITION. ANYTHING THAY HAPPENS TO MYSELF, MY CHILD AND ANYONE ELSE.

I have been more than understanding, patient, and caring towards this situation for almost 2 years.

THIS IS UNACCEPTABLE!!!

Mr DS Jacobs
