Breach of Warranty / Maintenance agreement

I bought a 2012 Nissan Tiida on 10 July 2014 from Nissan dealer in Cape Town.

The day I received the car the 45 000km service was done by the dealer. According to the warranty & maintenance book, the date of delivery to the 1st owner was 19 July 2012 from Imperial Nissan Parow. It was completed and stamped by them. The car came with a 3 year warranty & maintenance plan so I had till 18 July 2015 to take it for the 60 000km service.

On 4 June 2015 I contact Imperial Nissan Parow to book a service and was told that the warranty & maintenance plan has already expired.

I contact Nissan SA customer care and after a week they came back and told me that the car was sold to the 1st owner as a demo and not a new car and that the warranty expired on 23 May 2015.

So the service book say that the car was 1st sold on 19 July 2012 (completed & stamped by Nissan), but they say sorry it was actually the 23 May 2012.

This is Nissan's mistake and they need to take responsibility for it. I'm not going to pay for the 60 000km service and will fight for it.
