Trace Alert - Prescribed Debt
<p>I noticed a Trace Alert on my Transunion credit report. </p> <p>I would like for you to remove that trace alert because I do not owe you a cent.</p> <p>That account in question prescribed a long time ago.</p> <p>I would like for you to e-mail me a statement that reflects payments made in the last three years.<br />Show me proof that I made payment arrangement with you in the last three years.<br />Send me a copy of the court summons that was issued in the last three years.</p> <p>If not then please remove the negative listing you placed on my credit report.</p> <p>According to the Prescription Act 68 of 1969, section 10 (1), a debt is prescribed if:</p> <p>* You have not acknowledged the debt in the past 3 consecutive years, either in writing or verbally<br />* You have not made any payment towards the outstanding amount, nor have you promised to pay<br />* The creditor has not summonsed you for this debt within 3 consecutive years</p> <p> </p> <p>Please remove the trace alert as I am going to take this up with the National Council for Debt collectors.</p> <p>My ID no is ********** 228087. Have this resolved please.</p>
