I am lodging a formal complaint regarding accounts that were previously prescribed and should no longer be reflected as active adverse debt on my credit profile, but which have recently been reloaded and are now negatively affecting my credit record.
According to my credit report, the following accounts have reappeared despite having prescribed in or around December:
* Nimble Group Credit Card Account (Account No. ending 8000) * Nimble Group Instalment Account (Account No. ending 9012) *Nimble Group (Account No. ending 6492)
These accounts show significant arrears and outstanding balances, yet the debts had already prescribed and should not have been reloaded or reported as enforceable obligations.
I request that Experian:
1. Investigate the legality and accuracy of the reloaded accounts. 2. Verify with the data provider that the debts have not prescribed. 3. Remove the listings if the creditor cannot provide sufficient evidence that prescription was interrupted or that the debts remain legally enforceable. 4. Provide me with the outcome of the investigation and supporting documentation re**** upon.
Please treat this as a formal dispute in terms of the National Credit Act and applicable credit reporting regulations.
