POOR CUSTOMER SERVICE AND FAILURE TO COMPREHEND A COMPLAINT-191963

1. I entered into this contract for a fixed term and which term expired last year. Actually during November 2017, when I logged into my Tracker, it showed that that it was inactive and I could not locate my vehicle; If Netstar disagree with my assertion, I challenge them to make available tracking details/ records for August – December 2017. 2. In terms of Consumer Protection Act, Companies are compelled to contact the consumer in writing, before the fixed term expires and inform them of their options in terms of renewal - and what the financial implications will be. I was contacted after the expiry of the fixed contract by Netstar notifying me of the expiry and further requesting whether I would want to extend my contract and I emphatically told the official that I am not renewing the Contract. This was, like when I took the contract, done through recorded telephone call. The Contract was done through recorded conversation and why should it not be possible to terminate it same way?

3. Section 14 of the CPA deals with the expiry, renewal and cancellation of fixed-term agreements. Section 14(2)(b)(i)(bb), deals specifically with the customer’s right to the early cancellation of fixed-term agreements. The section states as follows: “14(2) If a consumer agreement is for a fixed term (b) despite any provision of the consumer agreement to the contrary (i) the consumer may cancel that agreement (bb) at any other time, by giving the supplier 20 business days’ notice in writing or other recorded manner and form, subject to subsection 3(a) and (b).” 4. As can be noted above, it is allowed to terminate the Contract in “other recorded manner and form”. Why would it be allowed for Netstar to enter and renew a Contract “ through recorded conversations and not allowed for me to do the same?

Please revise and adjust my account as the contract came to an end and I opted not to renew it. I at least hope and request that Netstar would looked into my complaint instead of referring it to Nudebt after over 17 years of been loyal subscriber to them.
