False advertising, no such thing as same day delivery

Dishonesty in advertising. After the site states same day delivery, I placed an order at 07:25 to be delivered before 4pm. First they call to explain that they do not have stock so they will give alternative, then at 13:00 they call to explain that they will not be able to deliver the goods, after express instructions that it must be delivered today. So can I have my money back immediately. False advertising at its best. Quick to take your money, slow to deliver
