On 25/7/2019 an amount of R12,521.00 was taken from my account, with the narrative: "Pymnt: ***", no further information was provided by Nedbank.
In terms of the recent reported judgment by Judge Keightley, AJ, passed on 27/6/2019, "it is ******** to apply the common law principle of set-off without the consent of the debtor; " and "The back is also required to notify the debtor of its intention to deduct funds from the account".
I was never contacted by Nedbank and have never agreed to any kind of set-off.
In terms of the above quoted judgment, I hereby demand that Nedbank pay back of the amount of R12,521.00.
As per the submissions of The SAHRC the transaction by Nedbank, has taken away my basic human right. It left me with insufficient accessible money to take care of my basic social necessities. The action of Nedbank constitutes ***** and has left me in a dire financial situation.
