Unjustified Enrichment

On the 15th November while trying to pay Doctors for an operation I had - I did an internet transfer from my Nedbank account into a W & I Trust account IN ERROR.

This money was intended for an anaesthetist.

After the error I then transferred the same amount to the actual Doctor who did my operation as he had this money due to him.

I then phoned Nedbank bank immediately on the 15th November to notify them of what I had done and asked them to please recall money from W & I Trust and not from the Doctor.

The lady then sent me a recall form and said I needed to submit this to Nedbank which I did on the 16th November requesting money be returned by W & I Trust.

Four days later I got a call from my Doctor (Anaesthetist) saying that Nedbank had requested him to repay monies to me – I then sent email to recalls to say they are requesting from the wrong person.

I then emailed on numerous occasions to enquire how far they had gotten but alas not response.

On the 10th December nearly a month later I then went into a Nedbank branch to lay a formal complaint.

14th December I got a call from a Manager informing me that they could not get authorisation from account holder to return money – I then informed her that they were requesting money back from incorrect person and therefore would not get authorisation - she then said she will ask them to try again!

All of a sudden a team leader from recalls centre also sent this message below on the 13th December:

If the payment is made to a pre-approved beneficiary then we cannot not do a recall

In this you will need to contact the beneficiary directly for refund

Thank you.

How can I contact them directly as bank will not supply me with contact details.

Recalls department only responded after I laid a formal complaint.

This is therefore unjustified Enrichment on the part of W & I Trust if they are unwilling to return my money as I have many more doctors bills to pay.

Nedbank cannot for one minute say I did not inform them timeously.

If someone had transferred a hundred thousand into my account in error Nedbank would have made every effort for me return the money.

I am highly disappointed in the service that I have received from Nedbank (Recalls).

Just because my amount is small does not mean that I am by the means to forget it.
