Unathorised deduction on home loan account

On 25 March 2026, Nedbank double deducted my home loan account without my consent. Yes I acknowledge that I missed the January 2026 payment, but without my consent, this deduction constitutes an ******** "set-off" under the National Credit Act (NCA) 34 of 2005. I told them that I needed the funds to pay for my daughter's school fees and transport fees, but I was told that the refund has been declined. I guess my child won't be going to school for the whole of April 2026 all thanks to Nedbank. Complaint ***. Sylvia from their Collections Dept & Oliva from their Complaint's Dept told me that it was their right to double deduct without the client's consent but when I ask for that confirmation in writing they refer me to the *********** Meshack Sibitlo. Sibitlo was supposed to contact me today 28 March 2026, but it was never done. According to the Act and the 2019 High Court ruling (National Credit Regulator v Standard Bank), the common law principle of automatic set-off does not apply to credit agreements regulated by the NCA. I have not provided Nedbank with a specific, written authorization that complies with Section 124, which requires the consumer to specify the bank account, the amount, and the date for such a transfer. This unauthorised withdrawal has caused immediate financial distress, impacting my ability to pay for my daughter's school fees and transport fees.
