SARS refund withheld by Nedbank on closed account

I am having an issue with funds that were deposited by SARS for my tax refund into a Nedbank account that was previously communicated as closed and referred for legal action and summons have sinced been issued as part of the legal proceedings. The SARS refund was transferred into the Nedbank account after the above actions and the issue was raised with Nedbank as the transaction did not fail as I understood it should have as it was communicated that the account is no longer active and I also have not been able to use it. The funds deposited by SARS have now been used to settle my overdraft debt with Nedbank without my consent. Nedbank legal considered the request for the return on the funds and they requested that I send proof of souirce of funds for the said SARS refund, for which I emailed my SARS statement of account. Nedbank is now refusing the request saying that the account is restricted for my use but the deposit was received even though the account was communicated as closed.

My issue is the fact that the account has been restricted for my use and handed over for legal proceedings, yet Nedbank, whom I believe is acting in bad faith has received and allocated funds into the account knowing full well that was not the intended use of the deposit. If the account is not available for use, all transactions - debits & credits - should not go through without prior agreement. Please assist as Nedbank is not acting in good faith
