Sale of execution

We have a bond with Nedbank since 2010, which was paid every month on time for around 3 years as I am ex staff & worked for them for about a decade. However I had lost my job in 2012 but continued making payment even in 2012 and 2013 with savings but this became exhausted and I officially found employment again in 2014 July and Nedbank had refinanced my wife and I and started their debiting us again. But just two years later, the company I was in was bought over and there was salary cuts and I was unable to keep up with regular payments, shortly after this I was let go in 2016 August. My only alternative was to take up a commission only job, Nedbank tried to restructure us last year 2017, however I was only able to make 2 payments and not 3 and so my second restructure fell through. With my commission earnings, my income was unstable, my wife had to take care of our monthly expenses which tal**** up to around R15k net per month and she did not have enough for the bond. Around July 2017, Nedbank called back and offered us to restructure as they were doing this with all their distressed homeowners, however they declined the restructure to “reckless spending” where my wife’s bank statement showed what debits and commitments was adhered to monthly. We felt this was unfair on for us as we have a 1 year old baby and really didn’t want to be homeless. We finally got an ultimatum that the only way out was through the Nedassist, with much hesitation and a pain in our gut, we agreed, because we said, rather it go like this instead of being auctioned off. But this was declined after it was offered because a payment of R11000 that Nedbank needed and this was in December 2017. Shortly after this, we receive an sms that our home is “attached” and now two weeks ago, we received an sms that our property has “sale of execution” on it. Our property was financed at R435k in 2010, we paid over R110k to Nedbank in the first 3years, upon refinancing Nedbank received another R100kplus in payments and with our restructure last year which failed, they had received another R10600. For an institution to receive over R220k which is more than 50% of the initial bond, granted It’s mostly interest but it is sad that they made a decision to auction us for a mere R11k which we just needed more time to get. This is not in line with Treating Customers Fairly. Not to mention, our legal fees have been duplicated which is *******, and adds on an extra R120k on the outstanding bond, we know it’s ******* as another Nedbank homeowner in our complex went through the same ordeal as me but she took Nedbank to court with her lawyers and she won the case. We urgently need our property to be removed from the sale of execution, so that we can finally clear the one year in arrears by means of quick instalments and keep our property, or Nedbank Assisted sale if we are unable to. We just want to be secure in our home and not be forced to be moved after all the years of dedication we have had with keeping our bond regular. Urgent Assistance needed from a distressed homeowner, please treat us fairly and don’t throw our home away for R11000
