Prescribed debt refusal

am in a dispute with Nedbank and a debt-collection firm regarding a personal loan that went into default in 2022.

The last payment was made in May 2022. Under the Prescription Act, the debt prescribed in May 2025.

When I raised prescription, I was told that a summons had allegedly been issued in July 2024. This was the first time I became aware of any summons — it was never served on me.

Despite this, I am still being pursued and the account remains listed with credit bureaus.

I have formally disputed this and requested proof of lawful service.

I am sharing this so consumers know that prescribed debts may not be enforced or listed once prescription is raised.
