Prescribed debt

Dear Nedbank Collections Department,

I am writing to formally dispute the recent deduction from my account regarding a credit card debt.I wish to place on record that this debt has prescribed in terms of the Prescription Act 68 of 1969. To my knowledge, the following conditions have been met:

1. Period of Inactivity: I have not made any payments toward this debt for a period exceeding three consecutive years.

2. Lack of Acknowledgment: I have not verbally or in writing acknowledged the existence of this debt during the last three years.

3. No Legal Summons: I have not been served with a legal summons for this debt within this timeframe.

According to the National Credit Act, it is ******** for a credit provider to collect or sell a prescribed debt.

I hereby request the following actions:

• Immediate Refund: Please reverse the unauthorized deduction made on 26 March 2026 and refund the amount of R10799.90 to my account.

• Proof of Debt: If you believe the debt has not prescribed, I request a signed contract and a complete statement of account proving that a payment was made or a summons was issued within the last three years.

• Account Closure: Once the prescription is confirmed, please provide written confirmation that this account has been closed and the balance written off.

I look forward to your response immediately .If this matter is not resolved, I will be forced to escalate this dispute to the National Credit Regulator (NCR) or the Ombudsman for Banking Services.
