<p>I am experiencing a debit order for a loan I have no contract for. Are they authorised to debit me without a copy of the said agreement? Is this not a breach of contract. How long does it take to get a copy of the contract? Billing is active yet I have no documentation of what I am paying for! Yesterday I spoke to the service champion at Nedank Cresta, she took my details and promised to get someone to call me and provided me with same-dololo! If I can say you have terrible service, I'd be dragging the word service through the mud. Nedbank has nothing-hope you get it.</p>

Section 54 of the Consumer Protection Act 68 of 2008 (ss53-54) is as follows:

Refer to subsection (2)

"If a supplier fails to perform a service to the standards contemplated in the subsection (1), the consumer may require the supplier to either-

(a) remedy any defect in the quality of the services performed or goods supp****; or

(b) refund to the consumer a reasonable portion of the price paid for the services performed and goods supp****, having regard to the extent of the failure.

You ( nedbank) have failed to provide me with proof of contract, yet you continue to deduct my account. I need to know what are you going to do about this. I will take this to the Ombudsman and National Complaints Commission. Is it permissible to deduct a onsumers account without a copy o fthe agreement delivered to the Consumer?

We will advise the Resolution Manager of your comments above.

Kindly note the bank has 21 working days to assist you with your complaint from the date of it being logged, if you still not happy with their response there after you welcome to take the matter to the Banking Ombudsman of South Africa as Nedbank support resolution via the Banking Ombudsman.

The conversation I had with Nicolas Govender (ref: ********** ) is unbecoming. Please pull the recording and advise if the mate has any listening s****s. He actually ******* me to say things on the line! I don't think he got the gist of the complaint. He sounded like the one making the complaint. Is it because I'm black? He violated my right to information. As an indian male, he acted in character to always complain without facts.

An imbecile just called me wanting to discuss a matter which is under investigation! Is is it a matter of the left hand not knowing what the right hand is doing? he has the audacity to ask "What is my expected outcome of the matter?" This is the same obnoxious question asked by the mate Nicholas. How do you ask for a finmal result when a case is in session? Provide what is requested. Stop calling me to trick me to say things I am unsure of on the line. I have given my directive, act on it! I am noting the harrassment that the Indian callers are subjecting me to. I have a leagl right to request for proof of contract.
