NON-COMPLIANCE TO A SARS INSTRUCTION

I have a small business account with Nedbank since 2014. My account went into a minus on Tuesday 27/07/21 with a debit for SARS of R37,500 A debit that was not expected. I called my business banker Thenji Melula to enquire and she said she did not know about it. I had a planned debit order for Monday night which was jeopardised by this large debit. I was stressed as my account was NEVER in a minus! to add to the pressure Thenji called me back and said the credit department is putting pressure because my account is in such a huge minus and how was I going to resolve. I had to transfer R38,000 into the business account to clear the minus status. BUT I HAVE A NEGATIVE STATUS ON MY BANK STATUS! Thenji got defensive when I questioned her regarding the debit that I was not notified of and she said SARS just takes money well I do not believe her because the instruction from SARS is clear! The letter from SARS is dated 21/07/21 the note below is from SARS it states as a matter of urgency be in contact with the client informing him her of the debit NO ONE INFORMED ME I CALLED IN AFTER RECEIVED A BANK NOTIFICATION Please Note: As a matter of urgency, please be in contact with the client; informing him/her of the debit to his/her account. I RECIEVED THE EMAIL AFTER I CALLED THENJI

It is important to note SARS has appointed Nedbank as its agent in terms of section 179 of the Tax Administration Act. The third party appointment (the appointment) is for a specific point in time and therefore we will only remit funds to SARS if there are funds available at that specific point in time READ THIS!!. If no funds are available Bank's appointment is automatically terminated. READ NEDBANK!!! I DID NOT HAVE R37.500 IN MY ACCOUNT!!! YOU KNOW I DONT HAVE AN OVERDRAFT BUT YOU DID THE DEBIT ANYWAY!!! The Bank has no further liability towards SARS for further payments READ READ READ!!!!. However, if funds were held and not paid over, the Bank becomes liable to SARS for payment of the amount specified on the appointment. NEDBANK IS APPOINTED AS THE AGENT, I AM YOUR CUSTOMER 1. YOU DID NOT INFORM ME PRIOR, THENJI SAID SHE ONLY RECIEVED THE LETTER ON THE MORNING OF THE DEBIT, SO IF NEDBANK ONLY RECIEVED THE LETTER ON THE MORNING OF THE DEBIT, WHO DID THIS DEBIT? A GREMLIN?? 2. THE TAX DEPARTMENT RECEIVED THIS INSTRUCTION BUT DID NOT INFORM ME - IT IS STILL NEDBANK! “We received instruction from SARS to debit the account as per attached instruction. If the client is disputing the amount they must contact SARS. THE LETTET STATES R50,000 NEDBANK TAX DEPARTMENT DEDUCTS R37,500 HOW DID THEY GET TO THIS AMOUNT? Please note that an amount of R37 500.00 was deducted from the client account on the 26th of July and on the 27th of July an amount of R29 000 was reversed due to account being overdrawn. YET AGAIN YOU REVERSE R29,000 HOW DO YOU GET TO THIS FIGURE? YOU KEEP BACK R8,500 HOW DO YOU GET TO THIS FIGURE? Please note that an amount of R8 500.00 will be paid over to SARS on the 2nd of August. If the client is disputing the amount she must contact SARS.” I have CC’d my manager Gerhard on this mail. I AM NOT A FOOL, NEDBANK YOU HAVE DONE ME A GRAVE INJUSTICE! I WANT ANSWERS ON HOW YOU GOING TO REVERSE THE DAMAGE DONE ON MY ACCOUNT THAT WENT INTO A MINUS!!!
