Nedbank Credit Card department is useless

<p>I sent the below on May 20th, to date it has not been resolved, how long does it take to resolve a query at Nedbank ? It seems to me like someone does not even know what their job is. </p> <p> </p> <p>I remember I had a credit card, I think it was in 2009 or somewhere there, I left my former employers in 2012 May,I then called and spoke to someone advising of my lack of income going forward, the person asked for a confirmation that I was no longer employed, I sent a letter, I was told everything will be handled.</p> <p> </p> <p>I never heard from the person or you or anyone since then, I think we are now 4yrs running, however recently when applying for this job, it came up that I have a credit card that I am in arrears of, I didn’t know what this was, because in 2014 I even app**** and received a loan. I am not sure if this credit card still exists, or whatsoever however it is affecting me in my work as well as company.</p> <p> </p> <p>Please note even if I was supposed to have arranged etc after I left my employers, this is 4 years later, no one ever called, not even a collections urgency.</p> <p> </p> <p>Now in the back of my mind, I believe that this has prescribed ,</p> <p>• The Prescription Act 68 of 1969 (“PA”) says it means a debt (for example payment of money) is extinguished after the lapse (passing) of a time period.</p> <p>• South Africa has different laws which specify time periods, for example the PA says contractual and delictual debts extinguish after 3 years from when prescription starts.</p> <p>• The debtor is not liable to the creditor for a debt after the time period has lapsed.</p> <p>• The creditor may not institute legal action against the debtor for a debt.</p> <p> </p> <p>Prescription starts:</p> <p>• As soon as the debt is due (a debt is due once the creditor can identify the debtor and the facts from which the debt arises).</p> <p>• If the debtor prevents the creditor from gaining knowledge of the debt (excluding debts arising from agreements) prescription runs from when the creditor has knowledge of the existence of the debt.</p> <p> </p> <p>• The running of prescription is interrupted by:</p> <p>o acknowledgment of liability by the debtor; or</p> <p>o a service of a process on the debtor, where the creditor claims payment of the debt</p> <p> </p> <p> </p> <p>with the above points, I am proving the prescription if this is still open as I do not know and cannot be sure. With this, I request that this be written-off, my ITC records be updated and/ any legal proceedings be stopped effective immediately.</p> <p> </p> <p>I await your response, in which case I will chose the course of my next action regarding this.</p> <p> </p> <p>Thank you</p> <p> </p> <p>Kind regards</p> <p>Vonani Mashila </p> <p>***</p>
