Duped by Nedbank Home Loan and unfair treatment
My name is Jane Maluleka age 54 and to be 55 years old on the 20 March. I had a bond with Nedbank for almost 17 years. I lost my job due to covid in June 2020 and this was reported to Nedbank with that hope that I might get another job to repay my monthly bond but we all know nothing hasn’t been easy since then. I tried getting a tenant then but everyone with lockdowns was in dire situation. In July 2021, Nedbank approached me with an idea that it will be best if I use their ASSIST process to help me sell the house rather than it get repossessed because with their assistance I could get 50% discount on my settlement, I felt that was a good deal considering my long unemployed time and the fact that I invested my whole 17 years, renovated from exterior to interior, being a ground floor and corner with huge garden I spent money on professional irrigation because it was my home I so much loved. Nedbank introduced me to their preferred house agent who confirmed that the settlement the bank expecting was R480K+ and their evaluator valuated the house @RR560k. Honestly. I wasn’t happy at all because that estate was valued between R760k to R800k. That was the first pain I felt during this process but I was tired of calls and the threats of attachments etc I just wanted peace and let that slide and by my calculation even though was not going to be a good compensation for my 17 years BUT I was at least going to get something to move on. During this sale process, I tried following up as to where we are but there was no communication except that everything was going smoothly and when I was told they had an offer for R540k and that also was a frustration because we were going lower and lower and the convincing that things are still bad not knowing that ALL this was for their benefit as a sale agent to get their commission not considering that I am losing my house after so many years and at my age where I might never get that bond opportunity again and I might end up homeless with no job. After I have been told by weavid and weavid that the transfer has been finalized and the house now its on the new owner’s name that is when they sent me the financial breakdown which shocked me and nearly took me back to hospital after I have been released due to the same stress. It showed me the settlement being R560K+ whereas the house sold at R540k? who does that when someone claimed to be assisting me? Where I still had other settlements to be made like my 2 levies (as the house was in an estate) plus Tshwane municipalities etc, these were not considered in that process of “helping me” This breakdown came back with a AOD form asking me to sign acknowledging a debt of R134K+, WHERE do I get this money when I am still unemployed and again homeless? If this was communicated to me prior selling my house to an extend of registration I would have declined the offer proceed with the tenant which could help me pay something towards the bank while I possible consider my own sale at the right value I see befit my sweat and years invested and only uses the transfer agents to assist by saving the middle man. I have been duped and wronged with closed cons and pros of Nedbank with a plan of taking my house away. This process is as good as my house being repossessed with no proper procedures followed and left me indebted with NOTHING to show I ever owned the house. My heart is shattered to have been played and everyone gone away with their commission and give away house and I am in the cold jobless with a huge debt, how fair is this? I need some clarity, how could they pay everyone without asking me if I know and acknowledge those debts? But sell someone’s house and use the sale money without communicating the process then dump me with a debt on top, I wasn’t considered in this process as if I never fitted in the picture and here I am now expected to pay more for their accomplishment of kicking me out in the cold?
