Breach of contract
My mother is a pensioner. She took her pension money and invested in a Nedbank Investment account 22 October 2025. The agreement was that every 4th of each and every month until term 21 October 2026. 4th of June 2026 came and my mother did not receive the promised deposit. My mother and I went to the Brooklyn Branch. She was then told that the problem was a FICA issue. She was told that the bank had tried to contact her and request her to come to any branch. My mother indicated that she had received no call or message. She was then told that the money would be deposited 5th of June 2026. The day came and went. 6th of June 2026 she went to Nedbank Centurion. They had her on the phone with the Investments team. Reference number:662 890 201. They informed her that the money would be deposited on 8th June 2026. Today there was still no deposit. She went to the Attlyn branch of Nedbank. They informed her that the money would be deposited 9th June 2026. They also informed her that the date had changed now due to all these matters. Firstly, how can you say that she needs to FICA less than a year after you started your investment. Secondly, a contract has been entered into with specific deliverables. My mother deposits her money with Nedbank and Nedbank pays her every 4th of the month. This is a breach of contract. Third, my mother is a pensioner. This is the only money she gets and now because of the breach of contract she can not meet her obligations. Water and lights will now impose penalties because of the late payment. Other payments are also going to be imposing penalties because of defaulting. Nedbank must pay these penalties as they have defaulted on their obligation to my mother.
