Holding my credit profile hostage and demanding for funds to release my profile

I am extremely concerned and dissatisfied with the manner in which my account has been handled. I cancelled my agreement with your company quite a few years ago, yet it appears that my credit profile continues to be adversely affected. This is particularly troubling given that I have since taken full responsibility for settling my debts independently, without any assistance from your organisation. The ongoing impact on my credit record is both unjustified and unacceptable. It creates the impression that your practices may be prioritising financial gain over genuine client support, especially during periods when clients are most vulnerable and in need of meaningful assistance. I hereby formally request that you urgently review and rectify my records to reflect the true status of my account. Failure to do so will leave me with no choice but to escalate this matter further. I also feel compelled to caution others to exercise due diligence when engaging with such services, as my experience has unfortunately not reflected the level of support and integrity one would reasonably expect.

Thank you for bringing this to our attention, and we’re really sorry to hear about your experience.
We understand your concern however please note that under the National Credit Act, a clearance certificate or a court order declaring you no longer over-indebted is required to remove the debt review flag.  This can be done once all your debt is settled or by approaching an attorney. If this was not done, it could be why your profile is still affected.
We kindly ask that you privately message us so that we can urgently investigate your matter and assist in getting this resolved as quickly as possible.
We’d appreciate the opportunity to engage with you directly on this and clear up any concerns, and once everything has been clarified, you may consider updating your review accordingly 🙏

I have made an attempt to engage directly with National Debt Counselors, as suggested in your response to my review, but have not received any feedback to date.
In order to resolve this matter amicably, I request the following:
That my name be cleared with the relevant credit bureaus; and
That I be provided with a formal clearance certificate confirming the same.
Upon receiving written confirmation that both of the above have been completed, I will honour my undertaking to remove all related posts.
I trust that we can bring this matter to a prompt and fair resolution. I look forward to your urgent response

I suggest you you change your Name to National Debt Con-artists, cause that would be appropriate in this scenario. People do not fall for this *****ulent company who claims that they will assist you with your Debts because speaking from experience they add more Debts on you instead.

We understand your frustration. Please note that it is possible that you had fees outstanding that were accumulated during the debt review process, which would have to be settled before we issue your clearance. You may request a breakdown of those fees, if this has not been given to you as yet. We operate in compliance with the National Credit Act therefore cannot withhold clearance where it's due save for instances such as relevant outstanding fees.

Our only desire is to assist you in an amicable, respectful and transparent manner.

I refer to my previous engagement with your company, which I cancelled some time ago due to serious concerns regarding the handling of my funds. It became evident that payments were being allocated towards your internal charges rather than being distributed to my creditors, resulting in my overall debt increasing instead of decreasing.
Given these circumstances, I am not prepared to entertain any claims of outstanding fees. I consider the matter closed from my side.
Accordingly, I hereby request that you take immediate steps to issue me with a clearance certificate and ensure that my records are updated with the relevant credit bureaus without further delay.
Please treat this matter as urgent. I expect written confirmation once the above has been completed..

I will get a consultant from our cancellations department to get in contact with you to assist further."

NDC response : Hi Akther, your request to communicate via WhatsApp has been acknowledged. Kindly be advised that the process for the clearance certificate is as follows: Paid up letters for all accounts listed on debt review will first need to be obtained, Fees payable of R4025 will be due, we will then proceed to print, commission and issue your clearance certificate ; The National Credit Regulator's(NCR) Debt Help System(DHS) will then be updated with the relevant status codes and lastly we will update the Credit Bureau Association(CBA) portal with all paid up letters and the clearance certificate for credit bureaus to clear the status. You will also receive your copy of the certificate once issued. I have attached the NCR guideline which is their rule system on the process to be undertaken for us to help you with the clearance certificate. My colleague has previously sent you the power of attorney - kindly sign and return it so that I am able to request and obtain all of your paid up letters. Thank you

Hi, thank you for your response and for outlining the process.

I note the steps you have indicated, including the requirement for paid-up letters, the updating of the NCR Debt Help System and Credit Bureau Association records, and the issuance of a clearance certificate.

However, I would like to clarify that I have already settled my obligations directly with my creditors, and as such, I request that you proceed with updating my status and facilitating the clearance process based on this position.

Kindly provide me with a clear explanation, with reference to the applicable NCR guidelines, as to why any additional fees or documentation (including the power of attorney) would be required under these circumstances.

I trust we can resolve this matter promptly. I look forward to your response.

[04/13, 15:29] National Debt Counsellors: Hi Akther, I completely understand your hesitation in providing the paid-up letters, and I appreciate your perspective. However, please note that we are unable to issue a clearance certificate without these documents.
While you are welcome to submit the paid-up letters directly to the credit bureaus to potentially update your account statuses, they will not be able to remove the debt review flag without a formal clearance certificate issued by the debt counsellor.
We are required to strictly comply with NCR regulations, and due to recent changes, we cannot update your status or issue a clearance certificate without the necessary paid-up letters. Deviating from this process would place us in breach of these regulations, which we cannot risk.
I’d also like to clarify that the fees are not causing any delays, as they are standard for the services rendered. The current delay is due to the absence of the required paid-up letters, which are essential for us to proceed.
Please know that we remain fully committed to assisting you, and as soon as we are able to obtain the required documentation in line with NCR guidelines, we will gladly move forward with issuing your clearance certificate.

While I acknowledge your reference to NCR regulations and the requirement for paid-up letters, I must respectfully express my concern regarding the continued delays in finalising this matter. As previously indicated, my obligations have been settled, and I am seeking the prompt and fair correction of my credit profile without unnecessary procedural obstacles.
Given the ongoing impasse, I have now begun seeking independent legal advice to better understand my rights in this matter, particularly in relation to the obligations of a debt counsellor once a consumer’s debts have been settled. It is my understanding that administrative requirements should not unreasonably delay or prevent the issuance of a clearance certificate where settlement has been effected.
In light of this, I kindly request the following:
Written confirmation of the specific NCR provisions you are relying on to refuse issuance of the clearance certificate in the absence of paid-up letters;
Clarification on whether any alternative verification methods can be reasonably accepted in lieu of these documents;
A clear timeline for resolution, should the required documentation be provided.
My intention remains to resolve this matter amicably and without escalation. However, should delays persist without a reasonable or lawful basis, I will be guided by my legal counsel on the appropriate next steps.
I trust that we can work towards a prompt and mutually acceptable resolution.

If you’ve ever been in a situation where a company refuses to provide a service unless you pay additional fees—despite you having already fulfilled your obligations—do you think that’s fair or justified?

Latest response received from NDC : Good day, Kindly be advised that fees will be due for the clearance process. In the event that you are able to provide us with all of the paid up letters, a 50% discount will be app**** to the fees due and the payment may be done once-off or over a period of 3 months. This means the amount you would only have to pay - if you send us the paid up letters - is R2012.50. This fee will be due to us for the :
• Updating your Debt Review status on the NCR Debt Counselling System
• Commissioning the clearance certificate
• Issuing the official Clearance Certificate to all Credit Bureaus
• Updating the Credit Bureau Portal with all validated paid-up letters and the commissioned Clearance Certificate
