MYAA Auto sold a non existent warranty for R11 310-00
I purchased a motor vehicle from MYAA AUTO. On the 6th od December 2016 I signed for a VW POLO and as stipulated in the contract, MYAA AUTO had to fix certain defects on the vehicle before I take delivery of the vehicle. On the 9th of December 2016, two MYAA AUTO employees merely dropped the vehicle off at my residence and intended to leave. I noticed that not all the defects were fixed as agreed upon and told the two employees that I was unhappy and would like for them to return the vehicle as this was not which was agreed upon. The two gentleman stated that they cannot take the vehicle back as they needed to get back to the dealership before close of business and the traffic was bad. I was left with the car and immediately contacted the salesman to notify her of this. Also, the engine cover was broken off and thrown in the boot. I had made my intentions known that I would like to cancel the contract well within the first 7 days as MYAA AUTO had not adhered to the agreed contract. The owner, Ashraf Abdurahman was extremely rude and abrupt, informing me that I have no grounds to cancel the said contract. I had visited the dealership in order to speak to Ashraf in person and he shouted and refused myself and my father entry into his office. After a few minutes of him shouting at us, he finally let us in where he again stated that he will not cancel the contract.
I had endless battles regarding the cancellation of the contract before the 7-day period. Thereafter, we were in constant communication with each other regarding the matter in which the company had to fix my Polo. Even though the matter was referred to MIOSA, MYAA AUTO was then adamant that they were not going to fix my vehicle, despite the fact that all those problems were identified within the first month or two.
Now, I am faced with yet another challenge. On the day of signing for the vehicle (6 December 2016) MYAA AUTO also sold me a one year Motormend Warranty for the amount of R11 310-00 and now that I need to claim against the policy they do not have record of any such policy. Apart from them confirming with me, I made contact with the warranty company, 2017/08/22 at approximately 11:45am and they confirmed that they do not have record of this policy. I quoted my ID number and the VIN Number of the vehicle and to complicate matters, their system does not pick up on anything.
I acknowledge that MYAA Auto did not honour the contract/agreement but what exactly did they then sell me and why did I have to pay an amount of R 11 310-00? We gave Yaasien (salesman at MYAA AUTO) the benefit of the doubt when he assured me that he was going to call my father back within a few minutes. After phoning a second time to speak to him, my father was then told that the people are conveniently in a meeting. This is De Javu as I experienced this all before, hence, you can also understand my frustration as I know this is going to be, yet another lengthy battle to sort out this mess.
I have exhausted all avenues in trying to cancel the contract as well as to get MYAA AUTO to fix the vehicle, however I have no luck at all. I was sold a one year warranty of R11 310-00 to be added to the final finance amount of the vehicle (over 72 months - which means the warranty amount becomes more than R11 310-00) and the warranty does not exist at all.
MYAA AUTO now refuses to respond to any emails and will not call myself nor my father back (hence my frustration and desperation as my car will not even start most days and breaks down after a few minutes of driving).
