"uncapped, unshaped and unthrottled", I think not

On an uncapped, unshaped and unthrottled package for fibre from Mweb as the the service provider and Vumatel as the infrastructure owner. Several speed tests that i have run at varying times of day and week gives me an average of below half the download speed and at times i have a higher upload speed than download (on the 10 download and 2 upload package). There are times of completely no throughput whatsoever and I have done enough testing to show that it is not just an intermittent issue. Even when we had the promotional line speed upgrade to 20MBps the trend continued so this show that upgrading the package is also out of the question.

How can you put the statement out there boasting about unthrottled and unshaped when the old ADSL line we previously had was more reliable with maximum throughput of 2MBps (supposed to be 4MBps but old connections on service providers side limited it.)
