Vodacom handing accounts over on MTN behalf

Dear MTN, Please note that I received a second letter of demand from your debt collectors, I provided proof, I am a customer of MTN please resolve this matter My accounts are all in credit and now the letter state Vodacom is involed.

RE: National Credit Act / Your Vodacom Account

Outstanding Balance Owing: R6026,54 We act on behalf of MTN (‘our Client’).

You are in breach of the terms and conditions on your MTN contract (the ‘Agreement’) in that you have failed to pay as per contractual obligation and full balance is therefore due and payable immediately. You have been in breach for at least 60 business days since this account was handed over by Vodacom to HP Attorneys.

To rectify this situation, you must pay within 10 days of receiving this letter and avoid pending possible legal action which may result in summons, judgement and attachment of your assets to recover outstanding balance plus legal cost incurred. We strongly advise you to contact us to reach a suitable payment arrangement. Attachment will evoke Sheriff’s office to conduct sale of your assets to recover full balance owed to our client.

We therefore strongly urge you:

Pay the full amount owing due within 10 days from the date of this letter; OR Contact us to make a firm arrangement for the repayment on the amount owing in monthly instalments.

We also give you notice, in terms of Regulation 19(4) of the regulations under the National Credit Act 34 of 2005 (NCA), of our intention to supply adverse information in respect of your default and in respect of the total outstanding amount to a credit bureau upon expiry of 20 business days from the date of delivery of this notice.

In terms of the NCA adverse information includes:

“classification of consumer behaviour, including classifications such as 'delinquent', 'default', ‘slow paying', absconded' or 'not contactable”'; and “classifications related to enforcement action, taken by the credit provider, including classifications such as 'handed over for collection or recovery', 'legal action', or 'write-off'”. You may refer this matter to a debt counsellor, alternative dispute resolution agent, consumer court or Ombud with jurisdiction, with the intent that any dispute may be resolved under the credit agreement or develop and agree on a plan to bring the payments under the credit agreement up to date.

DEAR MTN,

As of date I have not yer received any feedback on the matter that Vodacom handles my MTN account and account that was handed over for a value that is incorrect and my account status with mtn is in credit for months. so please explain the relation of the Vodacom and MTN on this account,
