UNWARRANTED DEFAULT LISTING: M-TEL SERVICE PROVIDER - MTN
I decided to use Hellopeter.com platform to review MTN because they have proven to be very effective on facilitating resolution of consumers’ disputes with the service providers. My review of MTN with regard to the above matter, is therefore as follows: In 1999 I took a cell phone contract with MTN which was duly paid up on 31/12/2002. Despite having fulfilled my contractual obligations, MTN continued to debit my account as I am still being charged to date. Due to the continued multiple debits by unknown entities, I closed my Standard Bank Cheque account in January. MTN therefore could not debit my account and so, decided to establish a default against my name with the Credit Bureau on the 31/01/2018 to the value of R324. MTN did this without having informed me in writing, about their intention to do so. On the 12/03/2018, VVM Debt Collectors, contacted me on behalf of MTN to arrange payment of R772.12 in relation to the above debt. I paid up the debt on the 16/03/2018 as arranged and a letter of acknowledgement of payment from VVM was sent to me in May. Now, what startles me, is the continued monthly charges (bill) MTN sends to me by email. The current debt with MTN on the same account stands at R494.14 which I am expected to pay on the 15th of September. I can produce evidence of all the above claims, should I be required to do so. In view of the above grievances, I would like MTN to provide me with answers to the following questions and thereby act in the interest of justice to relieve me off the continuing debt burden that they have unduly placed on me: 1. Why did MTN continue to charge me, long after my contract with them was paid up on the 31- 12- 2002, which effectively ended the contract? 2. Why did MTN hand me over to the Credit Bureau after failing to pay the unwarranted debt for only one month? 3. Why did MTN not inform me in writing as the law requires, about their intention to hand me over to the Credit Bureau? 4. Why, after paying up R772.00 to VVM, their Debt Collector, does MTN continue to charge me until now? 5. What am I being charged for, as my contract with MTN effectively ended after making the last payment on the 31/12/2002? 6. Why have MTN not updated my credit profile with the relevant Credit Bureau, after paying up the alleged debt? 7. How will MTN undo damage to my reputation as a bad payer of a debt that should not have been? 8. How will MTN compensate me for the inconvenience suffered as a result of default listing which makes it impossible for me to obtain a loan from any banking or financial institution? 9. How will I get back the funds which MTN has undeservedly debited from my account, including the R772.00 paid to VVM to settle the debt, which was not supposed to be? 10. How soon will MTN close my account and bring this matter to finality? Nothing will make me happier than a speedy resolution of the matter at hand.
