********* Conduct

From: Siphiwe **********
Sent: 07 July 2017 02:43 PM
To: ********** /> Cc: ********** ********** /> Subject: ********** 740081 - PZ Makombe
Importance: High

Hi Leoni

As per the discussion we had telephonically, please find attached the proof of payment for the Account.

As explained this account MTN *********ly handed the account over for collections to MBD. Whom has in numerous occasion harassed my father regarding this matter with sms’s and telephone calls.

We decided to pay the account at MBD, as MTN had no records of the handover amount and handover file. Unfortunately when I made the payments I was working at DMC (debt Collections company), as an Operational Manager and have lost all the documentation linked to this handover file.

Herewith again another payment made for this account and hoping that this matter will be once and for all be resolved from a collections perspective.

As I do intend taking the matter up with Ombudsman:

MTN had never sent written notification that the account was in arrears
MTN had not sent any notification that there is intention of handing over the matter, notifying him that they are proceeding with their reserved right to proceed with legal action.
In Numerous occasions on recording I have requested the original breakdown statement from MBD and MTN and that has never been provided. Working in the call centre environment all calls are recorded, meaning that evidence of those recordings are retrievable.
My father is unemployed and has been unemployed for more that 5years now and on record MBD only started to make contacted last year notifying us of this account. We have not made any acknowledgement of the account, however due to harassment we have decided to pay the account. Furthermore it has been stated that it is ******* to collected on Prescribed accounts, which both MBD and VVM and in breach of that law.

Kindly note I will be also copying this mail on HelloPeter and taking it further with my legal advisors.

Hope once you have received this proof of payment you will be furnishing me with a paid up letter as per your records of the outstanding amount and then from there I will proceed with my legal actions against MTN.

Upon receipt of my mail please do confirm

Siphiwe Makombe

Callcentre Manager

Cell: ********** 639

Email: **********
Tel: +27 (0) 43 **********
