*****ulent account on my name for 3 YEARS!!!!

I am writing to lodge a serious complaint regarding a *****ulent contract that was taken out in my name without my knowledge or consent. Despite multiple attempts on my part over the past three years to bring this to MTN’s attention and resolve the matter, I have been met with inexcusable delays, neglect, and continued victimization — to the point where my credit record has been negatively affected, and I am now being harassed for payment on an account I never opened.

Please allow me to outline the timeline of events, demonstrating the consistent failure on MTN's part to resolve this matter adequately:

TIMELINE OF EVENTS: 5–19 April 2022: I received four DebiCheck mandate requests from MTN (including MTN SP and MTNMONDO), all of which I rejected via my FNB banking app because I had not app**** for any MTN contract or product.

1 May 2022: A debit order of R545.02 was processed from my FNB account with the reference "Mtn Sp Ba***6", despite my rejections. I disputed the transaction with FNB and blocked all future debit orders.

23 July 2022: I logged a complaint with MTN via email (***-eff8-4***-d7be4321d440) outlining the *****. I asked MTN to investigate who app**** for the contract, what identity documents were used, and to remove the contract from my name. I received a response requesting a certified ID and affidavit.

5 March 2023: After receiving a call about the *****ulent account, I followed the instructions. I went to the Norkem Park Police Station, obtained a certified copy of my ID and a signed affidavit, and submitted everything to MTN (***-2e18-40dd-bb58-607b750db19f). I was informed that the query had been escalated (Ref: ***) — but no feedback was ever received.

1 December 2024: I visited an MTN store in Greenstone to apply for a contract but was informed that I had been blacklisted by MTN. I was told to contact ***.

2 December 2024: I sent another email to ******** (***-eed4-4a21-ba21-6f***caa), including all previous documentation and a note about my updated email address. I also called the number provided and spent over 13 minutes explaining the situation again. I was promised resolution within a few weeks. Nothing followed.

22 July 2025: I received an SMS from Nimble Group about a letter of demand for R7462.78 on account Ba***. I immediately phoned them and spoke to Nomafa Njikelana, to whom I once again provided all the documents I had already sent to MTN. She informed me that the original affidavit was now outdated and I would need to submit new documentation.

23 July 2025: I once again went to Norkem Park Police Station, drafted a new affidavit, obtained a fresh certified copy of my ID, and sent it through. I was then asked to sign my certified ID six times and return it — which I did.

It is utterly unacceptable that I, as a victim of identity *****, have had to go through multiple rounds of effort, police station visits, documentation submissions, emails, and phone calls — only to still have this *****ulent contract attached to my name, and now be pursued by debt collectors.

I have acted in good faith every step of the way. MTN, on the other hand, has:

- Failed to resolve this matter for over 3 years. - Failed to communicate or provide any feedback. - Neglected to remove a *****ulent contract from my name. - Caused damage to my credit reputation and financial profile. - Allowed third-party agencies to harass me for debt that is not mine. - Made me repeat the same steps and resend documents multiple times.

This is a gross failure of internal ***** controls, and a breach of my rights under POPIA, NCA, and CPA. MTN's conduct demonstrates a complete disregard for consumer protection, ***** escalation, and accountability.

Should I not receive a proper resolution, I will escalate this complaint to ICASA, the National Credit Regulator, the Credit Ombud, and other relevant authorities, including legal counsel if necessary.

I have not received any feedback regarding the above. Please take note of the following:

How MTN violated my rights under ICASA:
  • MTN failed to investigate and cancel a *****ulent contract in a reasonable timeframe.
  • MTN continued to bill me despite me not having signed or agreed to any contract.
  • MTN allowed a third party to use my identity for a contract — a failure in their KYC (Know Your Customer) process.

    How my rights were violated under NCR:
  • A credit agreement was *****ulently taken out without my consent.
  • MTN failed to conduct proper identity and ***** checks.
  • MTN or its partner (likely Mondo) continued to report the contract to credit bureaus despite the ***** complaint and supporting documents.
  • My credit profile was damaged due to inaction on a contract that should have been flagged and cancelled.

How my rights were violated under Credit Ombud:
  • MTN (or its agent) reported a *****ulent account to credit bureaus.
  • My credit score was harmed despite MTN receiving an affidavit and ID copy proving *****.
  • The dispute remained unresolved for over 2 years, with no meaningful feedback or action.
