Paying for defective phone

Purchased a Samsung Galaxy 4 on contract 18 months ago. Battery died about August last year. MTN claims that phone is out of production and can not supply me with a battery. Tried phoning regional manager but he claims the phone is not on contract only the sim card is. Have being paying for the phone without the benefit of using it.
